Terms of Service

These Terms of Service (the "Terms") are the agreement between you and CORE SHOP Inc., a Delaware corporation ("Core", "we", "us"), for your use of core.shop and the services that come with it (the "Service"). By creating an account or using the Service you accept these Terms. If you do not accept them, do not use the Service.

1. Who can use the Service

You must be at least 16 years old. Where the law of your country sets a higher age for using an online service like ours without a parent's or guardian's consent, that higher age applies to you. If you are 16 or 17, use the Service only if a parent or legal guardian has read these Terms and agreed to them on your behalf. We ask for your age when you create an account, and we may suspend or delete an account that does not meet these requirements.

The Studio, our virtual try-on, is for adults. It may only be used by, and may only show, people who are 18 or older.

2. What the Service is, and what it is not

Core is a fashion discovery service. It learns what you like from the choices you make at sign-up and from what you save, search for and open, and it uses that to recommend products and to answer searches written in plain language or made with a picture.

Core does not sell anything. We are not a retailer, a merchant or a marketplace. We take no payments, hold no stock and ship nothing. When you decide to buy a product, you buy it on the retailer's own website under the retailer's own terms. Core is not a party to that purchase and is not responsible for it.

3. Your account

Keep your sign-in details to yourself. You are responsible for what happens under your account. Give us accurate information, keep it current, and tell us if you think someone else has used your account. Do not impersonate anyone, and do not choose a username that misleads people or infringes someone else's rights.

4. Acceptable use

Our Acceptable Use Policy is part of these Terms. In short, you agree not to use the Service for anything unlawful, not to scrape or copy data from it, not to interfere with it or get around its security, not to reverse engineer it, and not to use it to build a competing product or dataset. The policy also sets the rules for content, including that no one under 18 may appear in a Studio photo, and explains how we enforce them.

5. Product information and links

The product information on the Service, including names, brands, pictures, prices and availability, comes from third parties and is shown as we receive it. We cannot promise it is accurate, complete or current. Prices and availability change and can be wrong. Product and brand names, logos and trademarks belong to their owners, and showing them does not mean those owners are connected with Core or endorse it.

The Service links to other websites. We are not responsible for what they contain, sell or do, and you use them at your own risk and under their terms.

6. How Core earns money

Core takes part in affiliate programs, including through Channel3 and other affiliate networks, and may earn a commission when you click certain links or buy on a retailer's site. This never changes the price you pay. Our Affiliate Disclosure has the details.

7. Recommendations and AI results

Recommendations, search results, avatars, try-on pictures and the other results the Service produces are generated by software and offered for your convenience. They are not advice. We do not promise that a recommended product will suit you, be available, be priced as shown or match the retailer's description. Buying decisions are yours.

Avatars and try-on pictures from the Studio are AI-generated illustrations, not accurate depictions. They do not reliably show how a garment will fit, hang or look on you, in size, proportion, colour, texture or detail, and you must not rely on them to choose a size or to buy. To the fullest extent the law allows, we accept no responsibility for differences between a try-on result and the real garment, or for decisions made on the strength of an AI result.

Our AI Policy, which is part of these Terms, says which AI providers we use, what we send them and what you can do about it.

8. Our intellectual property

The Service, including its software, design, branding and recommendation technology, belongs to Core and is protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable and revocable licence to use the Service for your personal, non-commercial purposes under these Terms.

9. Your content and your data

The preferences, searches, saves and other inputs you give the Service may be used by Core, worldwide and without payment, to run, personalise and improve it.

What you upload or create on the Service, such as photos, outfits, collections and your profile, stays yours. You grant Core a worldwide, royalty-free licence to host, store, reproduce and show that content as needed to run the Service, which includes showing to other people whatever you choose to make public, such as your profile, public collections and shared outfit pages. We may remove content that breaks our Acceptable Use Policy. How we handle your personal data is explained in our Privacy Policy.

10. No warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT PRODUCT INFORMATION WILL BE ACCURATE.

11. Limit of our liability

TO THE MAXIMUM EXTENT THE LAW ALLOWS, CORE AND ITS OFFICERS, EMPLOYEES AND AGENTS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR USE OF THE SERVICE, YOUR INABILITY TO USE IT, OR ANY TRANSACTION WITH A THIRD PARTY. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO USD 100.

Some places do not allow some of these limits, so some may not apply to you. Nothing in these Terms takes away rights that the law does not let us limit, including the consumer rights of people in the European Union.

12. Indemnity

You agree to compensate Core for claims, damages and costs that arise from your use of the Service or your breach of these Terms.

13. Ending the agreement

We may suspend or close your account at any time if you break these Terms or if we need to protect the Service. You may stop using the Service whenever you like, and you can delete your account yourself in Settings, under Account, with Delete account, or ask us to delete it at contact@core.shop.

14. Changes to these Terms

We may update these Terms. The current version is always on this page with its date at the top. Using the Service after a change means you accept the updated Terms.

15. Governing law and disputes

These Terms are governed by the law of the State of Delaware, USA, without regard to its conflict-of-law rules.

Any dispute about these Terms or the Service will be settled by binding arbitration run by JAMS under its Streamlined Arbitration Rules, seated in Wilmington, Delaware. The arbitrator's decision is final and can be enforced in any court with jurisdiction.

Opting out. You may opt out of arbitration by emailing contact@core.shop within 30 days of first accepting these Terms, with the subject line "Arbitration Opt-Out".

Exceptions. Either of us may bring a qualifying claim in small-claims court instead. Claims for an injunction to protect intellectual property rights may be brought in court.

No class actions. You and Core agree to settle disputes individually. Class actions and other collective proceedings are waived as far as the law allows.

The consumer protection rights of people in the European Union and the European Economic Area, including the right to bring proceedings in your own country, are not affected by this section.
